1. Acceptance of these terms

These Terms and Conditions ("Terms") govern your access to Picha AI at picha-ai.com and its related services. By creating an account, purchasing a package or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Accounts and eligibility

• Provide accurate information and keep your email address or phone number current.
• You are responsible for activity under your account and for protecting your password and OTP.
• One person must not create or control accounts to manipulate free credits, referrals, commissions or promotions.
• Minors may use the service only with appropriate parent or guardian consent and supervision.

We may suspend access where reasonably necessary to protect users, investigate abuse or comply with law.

3. The Picha AI service

Picha AI provides AI-assisted photo restoration, enhancement and generation features. Available features, models, costs, limits and processing times may change. AI outputs are probabilistic: results may be inaccurate, inconsistent, delayed or unsuitable for a particular purpose. Preview examples do not guarantee an identical result.

You are responsible for reviewing every output before using it, especially for official documents, advertising, professional decisions or public publication.

4. Your photos, prompts and permissions

You retain any rights you already hold in content you upload. You grant Picha AI a limited, non-exclusive right to host, copy, transmit, process, modify and display that content only as reasonably necessary to operate, secure and improve the requested service.

You confirm that you have all required rights and consent from every identifiable person depicted. You must not upload private or copyrighted material without authorization.

5. Acceptable use

You must not use Picha AI to:

• Create unlawful, abusive, defamatory, exploitative or non-consensual intimate content.
• Impersonate, defraud, harass or mislead another person.
• Create deceptive official documents or use generated passport-style photos contrary to an authority's requirements.
• Infringe privacy, intellectual-property or publicity rights.
• Probe, disrupt, reverse engineer or overload the service, bypass limits, automate abusive requests, or introduce malicious code.

6. Credits and subscriptions

Feature costs are shown before generation and may vary by feature, model or quality. Credits are deducted when a request is accepted or processed according to the displayed flow. Free or promotional credits have no cash value and may expire or be withdrawn if obtained through abuse.

Unlimited packages are subject to the displayed daily token limit and validity period. Unused daily allowance does not roll over unless expressly stated. Package access begins after confirmed payment and ends at expiry.

7. Payments and refunds

Prices are shown in Tanzanian shillings unless stated otherwise. Payments are handled through supported payment providers. A package is activated only after Picha AI receives a successful payment confirmation.

Completed purchases are generally non-refundable once credits or subscription benefits have been delivered or used. If payment succeeds but benefits are not delivered, or a paid generation fails without automatic restoration of value, contact support for investigation and an appropriate credit correction, retry or refund where required by applicable law.

8. Referrals, affiliates and promotions

Published reward and commission rates apply at the time a qualifying event is validated. We may reject duplicate, self-referred, automated, reversed, fraudulent or otherwise ineligible activity. Purchase commissions may be reversed when the underlying payment is refunded or cancelled.

Affiliate participants must accurately describe Picha AI, disclose promotional relationships where required, and avoid spam or misleading claims. Payouts may be subject to verification, minimum thresholds and reasonable fraud review.

9. Generated outputs and intellectual property

Subject to these Terms and third-party rights, you may use outputs generated for you. Picha AI does not guarantee that an output is unique, free from third-party claims, or eligible for copyright or trademark protection. Similar outputs may be generated for other users.

Picha AI branding, software, interfaces and original site materials remain owned by Picha AI or its licensors and may not be copied or resold without permission.

10. Third-party services

The service relies on AI, payment, SMS, storage and infrastructure providers. Their systems may be temporarily unavailable and may have separate terms. Links to third-party sites are provided for convenience and do not make Picha AI responsible for their content or practices.

11. Availability and changes

We aim to keep Picha AI available but do not promise uninterrupted or error-free operation. We may maintain, update, discontinue or restrict features, models or packages. Where practical, we will avoid unfairly removing paid benefits without a reasonable replacement or remedy.

12. Disclaimers

To the extent permitted by law, Picha AI is provided on an "as available" basis without warranties of merchantability, fitness for a particular purpose, non-infringement or guaranteed output quality. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by law, Picha AI is not liable for indirect, incidental, special or consequential loss, loss of opportunity, or harm caused by misuse of an output. Our aggregate liability for a claim relating to paid service will not exceed the amount you paid for the affected service during the six months before the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited.

14. Suspension and termination

You may stop using the service at any time. We may suspend or terminate an account for material breach, fraud, security risk, unlawful activity or repeated abuse. Provisions concerning payments, intellectual property, liability, disputes and records survive termination where their nature requires it.

15. Governing law, changes and contact

These Terms are governed by the laws of the United Republic of Tanzania. The parties should first try to resolve a dispute through good-faith support discussions before pursuing remedies available under applicable law.

We may update these Terms when the service or legal requirements change. Continued use after an updated version takes effect means you accept the revised Terms.
